Hello,

If someone wanted to create a product or kit that includes the Raspberry Pi board, what would be required from a legal standpoint to repackage and resell this product? Is this even possible?

Once example might be where the R.Pi is a component to a bigger project, such as the main board of a retro gaming console that also includes a case, controllers, cables, and additional software.

Another example might be someone who includes the R.Pi as part of a kit, such as an educational kit to learn programming, so the R.Pi is included as-is and additional manuals and accessories are includes to provide a complete package.

As far as I know, there are no restrictions on what you can do with it, including reselling, building in to kits, building in to commercial projects etc.

When you buy it, its yours to do what you like with, repackage and resell if you want.
However Raspberry Pi is a trademark, and we will have usage requirements to maintain the quality of the brand.

The board no, not at this time. Its a component.
An education packaged system in a case possibly, sometime next year.

Really? I thought it would be a legal requirement before it could be sold.

Short and broad answer as I understand it: selling as a dev board to the general public should not require a CE mark as it does not come under one of these 20 categories:

The Arduino has been through a similar debate and so far has no CE mark.

Once it becomes an educational pack for children/school then it could be perceived as a 'toy' which is one of the categories. The CE mark then becomes mandatory for trade in the EU market.

If a 3rd party wants to include it as a component in something requiring CE mark compliance, then that 3rd party can endeavour to meet the requirements to satisfy the CE mark and become the liable party under the terms of the mark for their product which happens to include the Raspi.

Good to know... One of the ideas I have in mind for the RasPi may well involve me making & selling MAME machines. It'll only be for my use to start with, but I may well sell them to friends/family if the interest is there.
