PI 3B+ Raspi-config menus out of sync in Ubuntu

hi just spotted something weird.
With raspi-config

if i go to raspi-config and then interface options ( no 3) on this one.
if i select camera it does the camera function ok.
if i select SPI it comes up Programmer error: unrecognized option
if i select I2C i get the SPI page, and like wise
for serial im getting ARM I2C
and for 1wire im getting the serial page,
and gpio im getting the one-wire page.
when i exit and its rebooting it leaving these messages behind
* Failed to find overlays directory
* Failed to find overlays directory
sed: couldn't open temporary file /proc/sedDV3WWk: No such file or directory
sed: couldn't open temporary file /proc/sedgSlEHl: No such file or directory
Im not to bothered about the menu just thought it was weird, but im trying to set the /dev/ttyS0 to not become the console on boot ( i believe the option Would you like a login shell to be accessible over serial set to no should stop this) and it does'nt seem to be able to save it.
is there a fix for this?
bit of a noob with linux in general , been using it a while but not in anger!

Im using ubuntu mate (18.04)
from dmesg i get
