You have to build the payload properly to prevent any damage to either the internals or whatever it might land on. Essentially, that means using polystyrene foam for packaging, and making sure that everything inside is secure so it won't move about at all. Also, of course, a parachute is used to ensure that the payload lands at a controlled speed.
I don't know what the rules are for balloon flights in the USA, but they certainly are allowed. You should check with USA balloonists about the rules (on radio frequencies/powers allowed, where you can/cannot launch from, obtaining a NOTAM, and limits on payload weights). Also, you should strongly consider obtaining a ham radio license as you will need one for almost any radio tracking options.
