I figured it out. I had Darkice starting automatically on boot. It took over the soundcard stopping other uses. Stopping Darkice freed up the card for other uses.

Yes I installed the custom kernel which is what made it work with darkice. I've contacted Hifiberry and they said they don't know what the problem is.
