I did run the raspi-config and in my boot config there is an entry already to disable SPI:

/boot/config.txt
.....
# Uncomment some or all of these to enable the optional hardware interfaces
dtparam=i2c_arm=on
#dtparam=i2s=on
dtparam=spi=off

I am still having the same problem.
